By accessing or using FractalCycles ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service constitutes acceptance of the modified Terms.

2. Description of Service

FractalCycles is a software-as-a-service (SaaS) platform that provides market cycle analysis tools. The Service allows users to:

• Upload or fetch market data (OHLCV price data)
• Analyze data using proprietary cycle detection algorithms
• View statistical validation of detected cycles
• Generate composite cycle projections
• Access related analytical tools and visualizations

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use the Service.

4. Subscription and Payment

4.1 Subscription Plans

4.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method for the applicable fees.

4.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods, except where required by law.

• Attempt to gain unauthorized access to any part of the Service or its systems
• Interfere with or disrupt the Service or servers connected to the Service

• Share your account credentials with others or allow multiple users to access a single account
• Upload malicious code, viruses, or harmful data
• Resell, redistribute, or sublicense the Service without authorization

You retain ownership of any data you upload to the Service. By uploading data, you grant us a limited license to process and analyze that data solely to provide the Service to you.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee the accuracy, completeness, or reliability of any analysis, projections, or results generated by the Service.

• Any loss of profits, revenue, data, or business opportunities
• Any damages arising from your use or inability to use the Service
• Any damages exceeding the amount you paid for the Service in the 12 months preceding the claim

You agree to indemnify, defend, and hold harmless FractalCycles and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and associated data
• Provisions that by their nature should survive termination will remain in effect

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FractalCycles operates, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class action lawsuits or class-wide arbitration.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FractalCycles regarding the Service and supersede all prior agreements and understandings.
